China PAT Successfully Defends OPPO’s Fast-Charging Patents Against ASUS

In September and October 2025, ASUS filed separate patent invalidation petitions with the CNIPA against two of OPPO’s core fast-charging patents. Following its examination, CNIPA issued separate decisions in May 2026, upholding both patents on the basis of amended claims. China PAT Intellectual Property Office represented OPPO throughout the proceedings.


The outcome preserved two commercially significant patent assets at the centre of OPPO’s fast-charging portfolio. The patents cover adapter and charging-control technologies used in OPPO’s fast-charging systems and form part of the technical foundation for rapid and safe charging. The technologies are closely associated with the consumer experience captured in OPPO’s well-known slogan, “five minutes of charging, two hours of talk time”.


ASUS challenged the novelty and inventive step of the two patents, as well as whether the amended claims were adequately supported by the patent descriptions. It relied on multiple prior-art references, arguing that the claimed inventions had already been disclosed or would have been obvious in light of combinations of the cited prior art.


Our team conducted a detailed analysis of the patents and the cited prior art, identifying the technical features that distinguished OPPO’s inventions from the references relied on by ASUS. We then developed a coordinated response addressing the proposed claim amendments, support for the amended claims, the cited prior-art combinations and ASUS’s arguments regarding the combination of the cited references.


At the oral proceedings, our team addressed the issues raised by the CNIPA panel and explained why the claimed inventions differed materially from the prior art in terms of the technical problems addressed, the means employed and the technical effects achieved.


CNIPA ultimately found that the cited prior art contained no teaching or suggestion that would have led a person skilled in the art to the claimed inventions, “particularly in terms of control objectives, control strategies and control methods”. The two patents were therefore upheld on the basis of amended claims 1–25 and amended claims 1–24, respectively.


In June 2026, the Zhengzhou Intermediate People’s Court handed down a first-instance judgment in OPPO’s patent infringement action against ASUS. The court found that the ASUS mobile phone adapter at issue infringed OPPO’s fast-charging patent and ordered ASUS to cease the infringement.


The patent asserted in the action was one of the two patents upheld in the invalidation proceedings. By confirming the patent’s validity and further clarifying its scope of protection, the earlier invalidation decision provided a stable basis for the subsequent infringement analysis and enforcement of OPPO’s patent rights.
